Computational law

Computational law is the branch of legal informatics concerned with the automation of legal reasoning. What distinguishes Computational Law systems from other instances of legal technology is their autonomy, i.e. the ability to answer legal questions without additional input from human legal experts. While there are many possible applications of Computational Law, the primary focus of work in the field today is compliance management, i.e. the development and deployment of computer systems capable of assessing, facilitating, or enforcing compliance with rules and regulations. Some systems of this sort already exist. TurboTax is a good example. And the potential is particularly significant now due to recent technological advances – including the prevalence of the Internet in human interaction and the proliferation of embedded computer systems (such as smart phones, self-driving cars, and robots). There are also applications that do not involve governmental laws. The regulations can just as well be the terms of contracts (e.g. delivery schedules, insurance covenants, real estate transactions, financial agreements). They can be the policies of corporations (e.g. constraints on travel, expenditure reporting, pricing rules). They can even be the rules of games (embodied in computer game playing systems). == History == Speculation about potential benefits to legal practice through applying methods from computational science and AI research to automate parts of the law date back at least to the middle 1940s. Further, AI and law and computational law do not seem easily separable, as perhaps most of AI research focusing on the law and its automation appears to utilize computational methods. The forms that speculation took are multiple and not all related in ways to readily show closeness to one another. This history will sketch them as they were, attempting to show relationships where they can be found to have existed. By 1949, a minor academic field aiming to incorporate electronic and computational methods to legal problems had been founded by American legal scholars, called jurimetrics. Though broadly said to be concerned with the application of the "methods of science" to the law, these methods were actually of a quite specifically defined scope. Jurimetrics was to be "concerned with such matters as the quantitative analysis of judicial behavior, the application of communication and information theory to legal expression, the use of mathematical logic in law, the retrieval of legal data by electronic and mechanical means, and the formulation of a calculus of legal predictability". These interests led in 1959 to the founding a journal, Modern Uses of Logic in Law, as a forum wherein articles would be published about the applications of techniques such as mathematical logic, engineering, statistics, etc. to the legal study and development. In 1966, this Journal was renamed as Jurimetrics. Today, however, the journal and meaning of jurimetrics seems to have broadened far beyond what would fit under the areas of applications of computers and computational methods to law. Today the journal not only publishes articles on such practices as found in computational law, but has broadened jurimetrical concerns to mean also things like the use of social science in law or the "policy implications [of] and legislative and administrative control of science". Independently in 1958, at the Conference for the Mechanization of Thought held at the National Physical Laboratory in Teddington, Middlesex, UK, the French jurist Lucien Mehl presented a paper both on the benefits of using computational methods for law and on the potential means to use such methods to automate law for a discussion that included AI luminaries like Marvin Minsky. Mehl believed that the law could by automated by two basic distinct, though not wholly separable, types of machine. These were the "documentary or information machine", which would provide the legal researcher quick access to relevant case precedents and legal scholarship, and the "consultation machine", which would be "capable of answering any question put to it over a vast field of law". The latter type of machine would be able to basically do much of a lawyer's job by simply giving the "exact answer to a [legal] problem put to it". By 1970, Mehl's first type of machine, one that would be able to retrieve information, had been accomplished but there seems to have been little consideration of further fruitful intersections between AI and legal research. There were, however, still hopes that computers could model the lawyer's thought processes through computational methods and then apply that capacity to solve legal problems, thus automating and improving legal services via increased efficiency as well as shedding light on the nature of legal reasoning. By the late 1970s, computer science and the affordability of computer technology had progressed enough that the retrieval of "legal data by electronic and mechanical means" had been achieved by machines fitting Mehl's first type and were in common use in American law firms. During this time, research focused on improving the goals of the early 1970s occurred, with programs like Taxman being worked on in order to both bring useful computer technology into the law as practical aids and to help specify the exact nature of legal concepts. Nonetheless, progress on the second type of machine, one that would more fully automate the law, remained relatively inert. Research into machines that could answer questions in the way that Mehl's consultation machine would picked up somewhat in the late 1970s and 1980s. A 1979 convention in Swansea, Wales marked the first international effort solely to focus upon applying artificial intelligence research to legal problems in order to "consider how computers can be used to discover and apply the legal norms embedded within the written sources of the law". Considerable progress on the development of the second type of machine was made in the following decade, with the development of a variety of expert systems. According to Thorne McCarty, "these systems all have the following characteristics: They do backward chaining inference from a specified goal; they ask questions to elicit information from the user; and they produce a suggested answer along with a trace of the supporting legal rules." According to Prakken and Sartor the representation of the British Nationality Act as a logic program, which introduced this approach, was "hugely influential for the development of computational representations of legislation, showing how logic programming enables intuitively appealing representations that can be directly deployed to generate automatic inferences". In 2021, this work received the Inaugural CodeX Prize as "one of the first and best-known works in computational law, and one of the most widely cited papers in the field." In a 1988 review of Anne Gardner's book An Artificial Intelligence Approach to Legal Reasoning (1987), the Harvard academic legal scholar and computer scientist Edwina Rissland wrote that "She plays, in part, the role of pioneer; artificial intelligence ("AI") techniques have not yet been widely applied to perform legal tasks. Therefore, Gardner, and this review, first describe and define the field, then demonstrate a working model in the domain of contract offer and acceptance." Eight years after the Swansea conference had passed, and still AI and law researchers merely trying to delineate the field could be described by their own kind as "pioneer[s]". In the 1990s and early 2000s more progress occurred. Computational research generated insights for law. The First International Conference on AI and the Law occurred in 1987, but it is in the 1990s and 2000s that the biannual conference began to build up steam and to delve more deeply into the issues involved with work intersecting computational methods, AI, and law. Classes began to be taught to undergraduates on the uses of computational methods to automating, understanding, and obeying the law. Further, by 2005, a team largely composed of Stanford computer scientists from the Stanford Logic group had devoted themselves to studying the uses of computational techniques to the law. Computational methods in fact advanced enough that members of the legal profession began in the 2000s to both analyze, predict and worry about the potential future of computational law and a new academic field of computational legal studies seems to be now well established. WomanStats Project

The WomanStats Project is a donor-funded research and database project housed at Brigham Young University that "seeks to collect detailed statistical data on the status of women around the world, and to connect that data with data on the security of states." The WomanStats Database aims to provide a comprehensive compilation of information on the status of women in the world. Coders comb the extant literature and conduct expert interviews to find qualitative and quantitative information on over 300 indicators of women's status in 174 countries with populations of at least 200,000. Access to the online database is free. == History and structure == WomanStats began as an outgrowth of a paper Dr. Valerie M. Hudson (of the Brigham Young University Political Science department) and one of her graduate students, Andrea den Boer, published in International Security on the association between national security and the abnormal sex ratio in Asia. After the success and influence of their first article, (later added as one of their top twenty national security articles of that journal of all time), Hudson and den Boer did further research on the connection between the status of women and national security, but found that there was no single database that covered the range of topics that they needed for their research. Consequently, they began compiling information on variables regarding the status of women around the world. The database was officially formed in 2001 and grew exponentially as it later added more variables. The Project went live on the Internet in July 2007. The principal investigators are: Valerie M. Hudson (International Relations), Bonnie Ballif-Spanvill (Psychology, emeritus), and Chad F. Emmett (Geography) all from Brigham Young University, Mary Caprioli from the University of Minnesota, Duluth (International Relations), Rose McDermott from Brown University (International Relations), Andrea Den Boer from the University of Kent at Canterbury in the United Kingdom (International Relations) and S. Matthew Stearmer from the Ohio State University (Sociology; doctoral student). Approximately a dozen undergraduate and graduate students at Brigham Young University and Texas A&M University work at any one time as coders for the project. The coders take the raw quantitative and qualitative data collected in government reports, news articles, research papers, etc. and sort the applicable information on women into categories. They may also implement scales developed by the principal investigators, or that they (the students) themselves have developed. == Database == As of February 2011, the database has 307 variables, covers 174 nations with populations over 200,000, uses 18,015 sources and contains over 111,000 individual data points. All data is referenced to original sources. Not every variable has information for each country; similarly, not all countries have information for each variable: overall, about 70% of country-variable combinations have information. These database coding gaps exist where information is not available or is incomplete, or variables are not collected and reported by governments or international organizations. At times, information from different sources may be contradictory, and the WomanStats Database records this discrepant information for triangulation purposes. == Users and role of the database == The database is meant to help fill a hole in the extant data on the situation of women around the world. WomanStats data and research has been vetted and/or used by the United Nations, the United States Department of Defense, the Central Intelligence Agency, and the World Bank. Their data and research were also used by the United States Senate Committee on Foreign Relations in crafting the International Violence Against Women’s Act. The Inter-Agency Network on Women and Gender Equality (IANWGE) of the United Nations has stated that the WomanStats project "filled a major gap in the availability of data on women" (2007). Victor Asal and Mitchell Brown, researchers not affiliated with WomanStats, stated in an article published in Politics and Policy that "one of the most significant challenges of cross-national empirical studies of the prevalence of interpersonal violence is the paucity of available data, particularly reliable data," and that "WomanStats has allowed for an important first glimpse at analyzing the factors related to interpersonal violence." They conclude by stating that "Our findings suggest that, in the same way that larger disciplinary resources have invested in interstate and intrastate war, disciplinary resources need to be expended in creating a data set exploring interpersonal violence. Until the rights and the lives of women and children are taken as seriously as the survival of states by more proactively collaborating on projects like WomanStats, we will continue to only have a small lens through which to understand problems like this." Princeton University professor Evan S. Liberman wrote, "Although data on political regimes and group conflict have been in far greater demand by political scientists than data on gender politics and policies, two gender-related databases provide...examples of innovative HIRDs. Both the Womanstats database project (Hudson et al. 2009) and the Research Network on Gender Politics and the State (RNGS) project (McBride et al. 2008) are well-integrated presentations of quantitative and qualitative data characterizing the quality of gender relations around the world and, in particular, analytic descriptions of the treatment of women."." == Research == The research component of WomanStats focuses on exploring the relationship between the situation of women and the behavior and security of states. Current research initiatives include: Exploring the relationship between violent instability and inequity and family law. Examining the effect of polygyny and marriage market dislocations on the rise of suicide terrorism. Documenting discrepancies between laws on the books and cultural practices on the ground concerning gender issues. Investigating how well the situation of women predicts the peacefulness of nations-states, compared to their variables such as democracy, wealth, and civilization. The Project has published articles in International Security, International Studies Quarterly, Peace and Conflict, Journal of Peace Research, Political Psychology, Cumberland Law Review, and World Political Review, and has a forthcoming book from Columbia University Press.

Storyful

Storyful (stylized as storyful.) is a social media intelligence company headquartered in Dublin, Ireland that is a subsidiary of News Corp, offering services such as social news monitoring, video licensing, and reputation risk management tools for corporate clients. The startup was launched as the first social media newswire, a content aggregator, verifying news sources and online content in Dublin in 2010 by Mark Little, a former journalist with RTÉ News. Storyful was acquired by News Corp in 2013 for USD$25 million. == Background == Mark Little, who had worked as a television journalist for RTÉ One, founded startup Storyful in Dublin, Ireland, in 2010, as a service that "verified news sources and online content". According to Nieman Lab, Storyful had a reputation for content aggregation as a social news agency—finding, verifying, distributing, licensing, and commercializing user-generated content, social media and online content from social networking services, including videos about stories in the news, such as the Syrian Civil War, Arab Spring protests, as well as "smaller viral moments". Storyful aimed to provide authority through its verification and monitoring tools while providing authenticity through user-generated content. On 20 December 2013 News Corp purchased Storyful for US$25 million and opened a New York office in the same building as Fox News' main studios. Little left Storyful in 2015 and Gavin Sheridan, Storyful's director of innovation left in 2014. News Corp CEO Robert Thomson said that through Storyful, News Corp would "define the opportunities that the digital landscape presents, rather than simply adapt to them." After the acquisition, the company expanded its service to include "commercial and creative work". After Murdoch acquired the company, from 2014 through to February 2018, losses "swelled", requiring a series of cash injections from News Corp. During that time the company expanded aggressively globally with a staff of about 200 worldwide up from about 30 in 2014. According to The Guardian, in 2016, journalists were encouraged by Storyful to use the social media monitoring software called Verify developed by Storyful. By installing Verify's web browser extension on their computers, Verify would inform the journalists when social media content had been "verified and cleared". The Guardian revealed that through the Verify plugin, dozens of staff in four offices had access to the journalists browsing activity without them knowing. This data allowed Storyful to actively monitor its own clients' activities on social media and to "turn it into an internal feed" at Storyful that "updates in real time". In November 2018, when a video circulated by Infowars' Paul Joseph Watson appeared to prove that CNN's Jim Acosta's contact with a White House intern was a physical blow, Storyful was able to prove that the 15-second-long clip had been doctored. According to a 21 January 2019 article in CNN Business, Rob McDonagh, the editor of Storyful's U.S. news team, had proven that one of the viral videos that served as catalysts in the January 2019 Lincoln Memorial confrontation at 18 January 2019 Indigenous Peoples March, was posted by a suspicious account, under the handle @2020fight. McDonagh's team validates videos and posts before adding them to their "digest", distinguishing true stories from those that are not. Storyful attempts to validate each post or video before including it in its digest. McDonagh reviewed previous content from @2020fight's account, and found it suspicious because it had a high follower count, a "highly polarized and yet inconsistent political messaging", an "unusually high rate of tweets", and "the use of someone else's image in the profile photo." reporter Donie O'Sullivan said that the @2020fight video that had been posted on 18 January, which had 2.5 million views by 22 January, was the one that "helped frame the news cycle". Currently the website offers a service by which video can be commercially brokered. == Services == Services include a newswire service—one of their "core pillars"—and social news monitoring. By February 2018, Storyful was developing "risk and reputation monitoring" services through which they would source and verify social news, fact-checking it and contextualising it for corporate clients. According to FORA, Storyful was developing new tools to combat fake news online. == Clients == When Storyful was acquired by News Corp in 2013, the company already had the Wall Street Journal, the BBC, New York Times, YouTube, ITN and Channel 4 News as clients. By 2018 their clients included CNN, ABC News and Fox News, The New York Times, the Washington Post, in the United States, the Australian Broadcasting Corporation and all of News Corp’s own publications. Most of their "reputation-conscious corporate customers" clients prefer to not be named.

Majal (organization)

Majal is a regional not-for-profit organization focused on "amplifying voices of dissent" throughout the Middle East and North Africa via digital media. Founded in Bahrain, the organization "creates platforms and web applications that promote freedom of expression and social justice." Majal, which relies on open source platforms, like WordPress and Ruby on Rails, was launched in 2006 by Esra'a Al Shafei as a simple group-blogging idea. However, it has changed course to focus on the development of unique applications and tools. == Objectives and means == Majal's content, in addition to its projects and applications, is free open source content to ensure right to access information for everyone. The organization uses a broad spectrum of social media tools, ranging from written blogs, podcasts, vlogs, comics, video animation and pictures to live broadcasting through radio. == Projects and applications == Majal runs various active projects that include Alliance for Kurdish Rights, The Muslim Network for Baháʼí Rights, a discussion tool for Arab LGBT youth and various Mobile apps. == Funding == Majal is funded through private donations and grants from non-governmental organizations, as well as any potential revenues earned through freelance development. Its primary funders are the Shuttleworth Foundation and the Omidyar Network. In 2008, Majal won the Berkman Award from the Berkman Klein Center for Internet & Society at Harvard University in the Human Rights/Global Advocacy category. This $10,000 award was Majal’s first source of funding. This award is presented to “people or institutions that have made a significant contribution to the Internet and its impact on society over the past decade.” In 2009, the March 18 Movement, a project of Majal, received the Think Social Award, which demonstrates how social media can be used to solve the world’s problems. Esra'a Al-Shafei was named a 2009 Echoing Green Fellow for Civil and Human Rights, a seed funding award for young entrepreneurs engaged in social change. Financially, the fellowship consists of a $60,000 stipend paid over two years. Ahmed Zidan of Egypt has served for over three years as the Editor-in-Chief of Majal Arabic, and is the co-founder of Ahwaa, and is also a podcaster. Other team members include Mona Kareem, Rima Kalush, Abir Ghattas, Namita Malhotra, and Vani Saraswathi. == 2011 Middle East and North Africa protests == Blogs and video played a role in the documentation of protests throughout the Middle East and North Africa during 2010-2011, also known as the Arab Spring. During this period, MEY's project, CrowdVoice (launched in 2010) helped curate and archive the large amounts of videos, images, and eye-witness reports being aggregated and crowdsourced from across the region. As a result, it had been censored temporarily in Yemen and is still censored in Bahrain. == Media coverage == Majal claims to have received various coverage from news agencies, TV satellite channels, radio stations, newspapers, magazines. ACTS Gigabit Satellite Network

The ACTS Gigabit Satellite Network was a pioneering, high-speed communications satellite network in the years 1993-2004, created as a prototype system to explore high-speed networking of digital endpoints. The system was jointly sponsored by NASA and ARPA, implemented by BBN Technologies and Motorola, and was inducted into the Space Technology Hall of Fame in April 1997. The Advanced Communications Technology Satellite (ACTS) network was designed to provide fiber-compatible SONET service to remote nodes and networks through a wideband satellite system, and provided long-haul, point-to-point and point-to-multipoint full-duplex SONET services, at rates up to 622 Mbit/s, over NASA's Advanced Communication Technology Satellite (ACTS). The Advanced Communications Technology Satellite itself, built and operated by Lockheed Martin, was launched on STS-51 on September 12, 1993, by the Space Shuttle Discovery, and occupied a geostationary orbit at 100° west longitude. It was the first communication satellite to operate in the 20–30 GHz frequency band (Ka band), with 30 GHz uplink and 20 GHz downlink signals. The satellite incorporated advanced on-board switching and multiple dynamically-hopping spot-beam antennas for selected areas of the United States including Hawaii. Up to 3 uplink and 3 downlink antenna beams could be active simultaneously. The ACTS network ground terminals were transportable Gigabit Earth Stations (GES) with fiber-optic SONET interfaces (OC-3 and OC-12), which also supported the Asynchronous Transfer Mode (ATM) protocol suite. The network control and management functions are distributed in the various Gigabit Earth Stations, with the operator's interface being centralized in a Network Management Terminal (NMT), which could be collocated at a GES, or anywhere in the Internet. The system was operational and used for experiments for 127 months, instead of the originally planned 24–48 months. In all, 53 terminals were built and used by more than 100 experimenters to test ACTS abilities. In Nov. 1997 a record data rate of 520 Mbit/s TCP/IP throughput was achieved using ATM between several ground stations via ACTS. On May 31, 2000 the ACTS experiments program officially came to a close, but the system continued to support experiments until it was deactivated on April 28, 2004.

EPUAP

ePUAP (Electronic Platform of Public Administration Services) is a Polish nationwide platform for communication of citizens with public administrations in a uniform and standardized way. Built as part of the ePUAP-WKP project (State Informatization Plan). Service providers are public administration units and public institutions (especially entities that perform tasks commissioned by the state). The platform provides service providers with technological infrastructure to provide services to citizens (recipients). Among the participants of ePUAP there are both central administration units and local governments, including municipal offices. Among the services offered by ePUAP is also Profil Zaufany (Trusted Profile), which enables electronic filing with legal effect without the need to use a qualified signature and SAML-based single sign-on mechanism, which enables the same ePUAP account to log on to websites of various service providers. The website www.epuap.gov.pl enables defining citizen and businesses service processes, creates channels of access to different systems of public administration and extends the package of public services provided electronically. Services available through the ePUAP platform may be accessed at the official website. Currently all administration services are available in Polish only. == Overview == It is described by the Polish government as "a coherent and systematic action program designed and developed to allow public institutions make their electronic services available to the public". The platform provides citizens, businesses and institutions with a number of services intended to ensure smooth and safe communication between: customer to administrations (C2A), business to administration (B2A), administration to administration (A2A). === Main goals === The main project objectives are to create a single, secure and electronic access channel to public services for citizens, businesses and public administration and also to reduce time and lower the costs of sharing information resources and functionalities of administration domain systems. Within the project, the following functionalities and services were delivered: Public services catalogue – a method of presenting and describing administration services, ePUAP platform – a web platform designed to provide public services on the Internet, Interoperability portal – a portal for experts working on recommendations for electronic documents and forms used within Polish administration systems to assure the uniformity of IT standards, Central Repository of Electronic Document Models – a database for valid document models and electronic forms. == History and background == The ePUAP project was carried out in the years 2005–2008. Currently, a continuation project ePUAP2 is being carried out with the following objectives: to increase the number of online services available to the public including the registry services, to widen the scale of usage of public electronic services, to integrate subsequent systems of public administration and business on ePUAP portal, to define new processes of customer and business services. === ePUAP2 === ePUAP2 is a public and administrative project that extends the set of functional services developed during the first edition of the project and is another step in the process of transforming Poland into a modern and citizen-friendly country. The implementation period for the project covers the years 2009–2013. Project financing The cost of the project “Construction of electronic Platform of Public Administration Services” – 32 million PLN was covered in 75% by the funds from the European Regional Development Fund (under the Sector Operational Programme "Supporting Competitiveness of Enterprises for the years 2004–2006"), while the remaining 25% of the cost was covered by a Polish national co-financing. Funds for the ePUAP2 project were gained from the 7th priority axis of the Innovative Economy Operational Programme and amounts to 140 million PLN (85% of eligible expenses were covered by the European Regional Development Fund, 15% were covered by a national co-financing). The trustee of ePUAP is the Polish Ministry of the Interior and Administration. == Legal regulations == According to the Polish law from 1 May 2008, public authorities are required to accept documents in electronic form (bringing applications and proposals and other activities in electronic form). ePUAP enables public institutions to meet this requirement by providing a service infrastructure to set up am electronic inbox. The ePUAP inbox meets legal requirements, in particular: issuing an official confirmation of receipt in accordance with the regulation of the Prime Minister of 29 September 2005 on the organizational and technical conditions for the delivery of electronic documents to public entities; cooperation with hardware security modules (HSM), meeting the technical requirements set out in the law; handling documents electronically in accordance with the minimum requirements set out in the Regulation of the Polish Council of Ministers of 11 October 2005 on minimum requirements for ICT systems. == Incidents == === Crashes === The ePUAP system very often happens smaller or larger failures. Because it is used to sign the application profiles trusted also in other electronic systems such as public administration. Electronic Services Platform created by ZUS, the system fault ePUAP it very difficult to settle official matters most electronically. === "Infoafera" === According to TVN and the release of TVP News from 10 April 2014, the creation of ePUAP is also associated with the so-called "Infoafera." On 10 April 2014, the Minister of Internal Affairs of Poland confirmed the information that the American technology company HP confessed to its participation in the Polish info-tour and corruption of Polish officials. G.9972 (also known as G.cx) is a Recommendation developed by ITU-T that specifies a coexistence mechanism for networking transceivers capable of operating over electrical power line wiring. It allows G.hn devices to coexist with other devices implementing G.9972 and operating on the same power line wiring. G.9972 received consent during the meeting of ITU-T Study Group 15, on October 9, 2009, and final approval on June 11, 2010. G.9972 specifies two mechanisms for coexistence between G.hn home networks and broadband over power lines (BPL) Internet access networks: Frequency-division multiplexing (FDM), in which the available spectrum is divided into two parts: frequencies below 10 or 14 MHz (specific value can be selected by the access network) are reserved for the access network, while frequencies above them are reserved for the in-home network. Time-division multiplexing (TDM), in which the available channel time is split equally between both networks. 50% of time slots are allocated for the access network, and 50% are allocated to the in-home network.
